The High Court has dropped Rafiur Rabbi’s petition challenging cancellation of his nomination in the Narayanganj-5 by-poll.
The bench of Justices Mirza Hussain Haider and Muhammad Khushid Alam Sarkar removed it from cause list while hearing the petition on Monday.
As the plea has not been dismissed, Rabbi can move another bench, his lawyer Shah Md Munir Sharif said.
But no decision had been taken yet, he added.
Rabbi said he would make his next move after consulting his lawyer.
The EC, on June 1, had cancelled nomination of two candidates. The other aspirant was Hamidur Rahman Khan Bhasani of the Bangladesh Nationalist Front.
Rabbi’s candidature was cancelled for defaulting on loan repayments.
An independent candidate is required to submit a list of one percent of voters who support his or her candidature while filing nomination.
Ten from the list submitted by Rabbi were selected by the election office, but two of them denied endorsing him.
Rabbi appealed against the cancellation of his nomination with the Election Commission.
But the EC rejected his appeal on Jun 5.
He, then, filed a petition to the High Court on June 9.
Rabbi’s son, A-level student Tanvir Mohammad Twaki, was killed a year ago by unknown assailants.
Joining the fray as an independent candidate, he said it was part of a movement to seek justice for his son.
The parliamentary seat had fallen vacant after the death of Nasim Osman, an MP from the Jatiya Party.
The ruling Awami League decided to leave the seat for the opposition JP, which is also a part of the government.
The JP has nominated Osman’s younger brother Selim Osman to contest the seat.
AL leader Anwar Hossain, who joined the by-poll fray in defiance of his party’s decision, pulled out of the race.
Only five people are now left in the contest for the June 26 by-election.
