Gazette notification of disciplinary rules for lower judiciary: SC sets fresh deadline for govt

The Appellate Division on Monday asked the government to notify the disciplinary rules for the lower court judges by January 15.
Since August 28, it was for the 3rd time that the apex court gave time to the government to do the job.
At Monday’s hearing appearing for the government, attorney general Mahbubey Alam prayed for two more months to resolve the issue.
Responding to summons from the apex court, secretary of the law and justice division ASSM Zahirul Haque and secretary of the legislative and Parliament affairs division Mohammad Shahidul Haque appeared and said that they would comply with the court’s directives on the issue of disciplinary rules for the subordinate courts.
At the same hearing when the attorney general informed the court that the President considers that there was no need for the disciplinary rules, Chief Justice SK Sinha pointed out that the law ministry statement shows that the President was wrongly briefed that the disciplinary rules were written by the Supreme Court.
Actually, said the Chief Justice, the disciplinary rules for the lower court judges were written by the law ministry in the pattern of the Government Servants’ (Conduct) Rules 1979 and the Supreme Court only modified the rules to suit the judicial officers.
The Appellate Division’s directive regarding the disciplinary rules for the subordinate courts should be implemented, submitted the attorney general, adding, ‘I don’t want to close the chapter at this stage.’
‘I want to resolve the issue,’ submitted the attorney general.
The judiciary being one of the three organs of the state should not be treated as the government’s opponent, said the Chief Justice.
Law minister Anisul Huq refrained from making any comment on the fresh deadline set by the apex court to notify the disciplinary rules for the subordinate courts.
In his evasive reply to reporters, Anis said he was not authorized to say anything on the President’s decision.
He took no other question and hurriedly left his office in the secretariat.
