The Appellate Division of the Supreme Court on Tuesday upheld a High Court order asking the government not to arrest suspended Gazipur City Corporation (GCC) mayor MA Mannan arrested in any criminal case without following the law.
Appellate Division Chamber Judge justice Syed Mahmud Hossain passed ‘no order’ on a petition filed by the state challenging the HC order.
Earlier on 29 November, a two-member HC bench comprising justice Quamrul Islam Siddique and justice Sheikh Hassan Arif asked the government not to show Mannan arrested in any criminal case without court order.
It also asked for not detaining him at jail gate showing him arrested in any case.
At the same time, the court had issued a rule asking the authorities concerned to explain why his arrest at jail gate showing him arrested in new case should not be declared illegal.
Home secretary, inspector general of police (IGP), deputy commissioner and Gazipur police super and officers-in-charge of all police stations of the district and others concerned have been asked to reply to the rule.
On 24 November, the Appellate Division of the Supreme Court upheld the bail order given by the HC to suspended GCC mayor MA Mannan, keeping no further bar to his release.
However, on the following day, Mannan was shown arrested in another case.
Later, he filed a writ petition with the HC.
On 11 February last year, law enforcers arrested Mannan. He was shown arrested in 22 cases. However on 2 March, he was released on bail. On 15 April, law enforcers again arrested him.
