The Supreme Court on Tuesday set 31 March as fresh deadline for submitting the summary of appeal petition filed by convicted war criminal Motiur Rahman Nizami against his death sentence.
The new deadline has been given after both the defence and the prosecution failed to produce the summary of appeal to the Appellate Division of the Supreme Court on the last day (Tuesday).
The four-member Appellate Division bench headed by Chief Justice SK Sinha granted the extended timeframe and asked the two sides to submit the appeal summary within 31 March.
On 24 February, the Appellate Division ordered them to produce the summary of appeal before the court within the next two weeks that fell on 10 March.
Attorney general Mahbubey Alam represented the prosecution during the hearing. Advocate on record Jaynul Abedin Tuhin was the defence lawyer.
The defence appealed to the Appellate Division to provide four weeks for submitting a concise version of the statement.
Upon hearing of the appeal, the apex court extended the deadline.
Shishir Manir, Nizami’s lawyer, told Prothom Alo that the Appellate Division asked both the sides to submit the summary within 31 March.
In default, the appeal will be considered ready for hearing.
The International Crimes Tribunal-1 on 29 October 2014, sentenced Niazmi to death for crimes against humanity during the liberation war in 1971.
Nizami pleaded his innocence and filed an appeal petition against the death penalty.
