BNP demands Justice Choudhury’s arrest

The party’s Joint Secretary General Ruhul Kabir Rizvi on Saturday urged the chief justice to order Choudhury’s arrest and trial.

Rizvi told the media at the BNP headquarters: “Justice Shamsuddin Choudhury had dual citizenship. Those who are loyal to other countries cannot work for their own country’s benefit.”

Rizvi wondered whether the dual citizenship of a judge was acceptable.

“This former ‘black sheep’ of the judiciary should be tried for hiding his dual citizenship while serving as a judge.”

Choudhury, who retired from the Appellate Division of the Supreme Court in October last year, has often been under the media spotlight for his harsh criticism of Chief Justice SK Sinha.

Of late, Choudhury has accused Sinha of being ‘politically motivated’ and demanded his resignation after the latter issued a directive saying no judge would be allowed to write judgements after retirement.

Last year, Choudhury had also written to President Md Abdul Hamid, alleging violation of the Constitution, breach of oath, and misconduct by Chief Justice Sinha and sought his impeachment.

Rizvi said at Saturday’s press briefing, “Justice Choudhury is a tool in the hands of the present illegal government to establish a one-party rule.”

Choudhury was appointed to fulfil the government’s wishes and worked to turn the Supreme Court pro-Awami League, he alleged.

The BNP leader said Justice Choudhury and former chief justice ABM Khairul Haque had ‘undermined a judge’s neutrality’.

The BNP supports Justice Sinha’s stand that the writing of judgments after retirement is unconstitutional.

They claim Sinha’s observation proves that a court order that did away with the provision of a caretaker government from the Constitution in 2011 was ‘illegal’.
