Amended law contradicts constitution: ACC chief

Head of Anti-Corruption Commission today said some provisions of the amended ACC law are contradictory to the country’s constitution.

“According to the Article 27 of the constitution, all people are equal before the law. But the amended ACC act will provide extra facilities to the government officers,” Mohammad Badiuzzaman said reacting to the changes passed by the parliament yesterday.
Ignoring all criticisms and recommendations of the parliamentary committee on law ministry, the House passed the bill introducing provision that requires the anti-graft body to take permission from the government before filing graft cases against public officials.
Speaking to reporters at his office in the capital, he said the newly amended act not only contradicts the constitution but also a provision of the ACC act.
According to Section 24 of the law, all three commissioners of the ACC will be independent and they will approve charge sheets in ACC cases.
The new provisions have made it mandatory for the ACC to take government’s approval in filing charge sheets against government officers.
