Indian High Commission spokesperson Sujit Ghosh on Friday told bdnews24.com that “the Competent Authority of Border Security Force” decided “to hold a revision trial in the death case”.
A BSF media release said, “On 07.01.2011, Ms Felani Khatun died on Indo-Bangladesh International Border in the area of Border Out Post Choudharyhat, Coochbehar, West Bengal due to firing by Ct Amiya Ghosh of 181 Bn BSF.”
“A General Security Force Court (GSFC) trial against Ct Amiya Ghosh of 181 Bn BSF, was held on a charge under section – 46 Bn BSF Act- 1968 for alleged killing of the Bangladeshi girl.
“The trial court found the accused Ct Amiya Ghosh ‘Not Guilty’ and pronounced findings on 06.09.2013.
“As per BSF Act and Rules, proceedings were reviewed by legal experts. The Competent Authority has not agreed with the findings of Court and has decided to hold Revision Trial in the instant case,” it read.
Foreign Minister Dipu Moni on Thursday at a press conference had said that Bangladesh would appeal if justice in the Felani murder case was not meted out after the final verdict in the Indian court.
“We’ll definitely appeal,” she had said, adding that the government had sought details of the final trial process of the much-talked about border killing that took place more than two years ago.
Felani was shot dead by BSF personnel on Jan 7, 2011, while she was trying to cross the barbed-wire fencing near Choudhuryhat.
The killing had led to huge outrage in both Bangladesh and India after her body was seen hanging from the fence.
After the special BSF court acquitted the guard accused of murder, the Indian High Commission in Dhaka had urged all quarters to wait for the trial’s final outcome, saying “this is only the first step” and that the judgment would be reviewed by a competent authority.
