Fakhrul: Swearing-in unconstitutional

The Speaker has violated the constitution by conducting the oath ceremony, Fakhrul claims

The swearing-in of new parliament members on Thursday was in violation of the constitution, BNP acting Secretary General Mirza Fakhrul Islam Alamgir claimed.

Speaker Shirin Sharmin Chaudhury violated the constitution by conducting the oath-taking ceremony, the BNP leader said in a statement on Thursday evening.

“If President Abdul Hamid invites the parliament leader to form government, he will also be violating the constitution,” Mirza Fakhrul said.

The BNP leader cited article 123 of the constitution in a bid to justify his statement.

As he stated, the article says elected parliament members will not take over responsibilities until the term of previous government ends – which is January 24.

“Today’s (Thursday) swearing-in is a clear violation of the constitution,” Fakhrul said in the statement. “All this was done to remain in power.”

“It is to be remembered those who violated the constitution today, it is they who enacted punishment for violators of the constitution through 15th amendment.”

The BNP leader warned that all concerned will have to be “indicted one day” for such offense.

However, President Abdul Hamid has invited leader of the parliament and Prime Minister of previous government Sheikh Hasina to form new government.

Mirza Fakhrul also slammed the “farcical” January 5 elections but did not leave any pointers for supporters on the next course of programmes.

“Time will come and the people will answer this farce,” he said at the end of the statement.
